Buildr End-User Terms of Service
These End-User Terms of Service ("Terms") constitute a binding and enforceable agreement between NovaRidge Commerce LLC, doing business as Buildr ("Buildr," "we," "us," or "our"), and you ("User," "you") each time you access or use the Buildr Services.
Buildr and you may each be referred to as a "Party" and collectively as the "Parties."
Billing Descriptor
Please note that charges for purchases made on our website will appear on your bank or credit card statement under the descriptor Buildr. By completing a purchase, you agree that the transaction will be processed and displayed using this billing descriptor.
By accepting these Terms electronically or by using the Services, you agree to comply with them. If you do not agree, you may not use the Services.
ARBITRATION NOTICE FOR U.S. USERS
THESE TERMS CONTAIN A MANDATORY ARBITRATION CLAUSE AND A WAIVER OF CLASS ACTION RIGHTS.
Except for certain disputes described below, you and Buildr agree that disputes will be resolved by binding individual arbitration, and you waive any right to participate in a class action or class-wide arbitration. You may opt out as described in Section 10.

2. The Services
2.1.
Buildr provides a subscription-based digital platform offering educational tools, learning resources, preparation materials, and related services ("Services").
2.2.
By subscribing or purchasing access, you gain access to the Services during your active subscription or access period.
2.3.
Subscriptions automatically renew at the end of each billing cycle (for recurring plans) unless canceled before renewal.
2.4.
Buildr reserves the right to add, remove, or modify features or content at any time.
2.5.
Subscription charges may appear on your billing statement as “Buildr” or our payment processor’s name.
3. User Access and Eligibility
3.1.
You agree to provide accurate and complete information when making a purchase or interacting with the Services.
3.2.
You are responsible for maintaining the security of any access credentials, links, or devices used to access the Services.
3.3.
You must notify Buildr immediately of any unauthorized use or suspected misuse of access to the Services.
4. Restrictions of Use
You agree not to:
(i) Access the Services by unauthorized means;
(ii) Circumvent access restrictions;
(iii) Share access links or credentials where access is intended for a single user;
(iv) Reverse engineer or attempt to extract source code;
(v) Transmit unlawful or infringing content;
(vi) Disrupt or impair system functionality;
(vii) Use bots or automated systems without authorization;
(viii) Copy or distribute content without permission;
(ix) Use the Services to build a competing product.
5. Subscription and Payments
5.1.
By subscribing or purchasing access, you authorize Buildr to charge your payment method at the beginning of each billing cycle or at the time of purchase.
5.2.
Subscription fees are charged in advance.
5.3.
You are responsible for maintaining valid payment information.
5.4.
If payment fails, Buildr may suspend or terminate access.
5.5.
Fees are exclusive of applicable taxes.
5.6.
Buildr may change subscription prices with 30 days’ notice.
5.7.
You may cancel at any time. Cancellation takes effect at the end of the current billing period.
6. Refund Policy
6.1.
Refunds are provided in accordance with applicable law and this policy.
6.2.
Refund eligibility may include:
Subscriptions canceled within 7 days of purchase or renewal (if not substantially used);
Verified technical issues preventing access;
Failure to deliver Services as described.
6.3.
Refunds are not available for:
Substantially used subscriptions;
Short-term access plans once started;
Chargebacks initiated without contacting support first.

Approved refunds will be issued to the original payment method.

Initiating a chargeback may result in suspension of access to the Services.
7. Your Data
7.1.
Buildr may collect and process personal data including name, email address, IP address, subscription details, usage data, and billing information.
7.2.
Your personal data remains yours, subject to rights granted under the Privacy Policy.
7.3.
Buildr processes data in accordance with its Privacy Policy and applicable data protection laws, including GDPR and U.S. state privacy laws where applicable.
8. Intellectual Property Rights
8.1.
All rights, title, and interest in the Services, platform, content, and technology are owned by Buildr or its licensors.
8.2.
You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use during your active subscription or access period.
8.3.
You may not reproduce, distribute, or create derivative works without authorization.
9. Disclaimer; Limitation of Liability
9.1.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
Buildr disclaims all warranties, express or implied.
9.2.
To the maximum extent permitted by law, Buildr shall not be liable for lost profits, lost data, or indirect, incidental, special, punitive, or consequential damages.
9.3.
Buildr’s total liability shall not exceed the fees paid in the 12 months preceding the claim.
9.4.
Nothing limits liability where such limitation is prohibited by law.
10. Dispute Resolution and Arbitration
10.1.
For U.S. users, disputes shall be resolved by binding arbitration in Wilmington, Delaware.
10.2.
Arbitration will be administered by JAMS under its Comprehensive Arbitration Rules.
10.3.
Arbitration will be conducted on an individual basis only.
10.4.
You may opt out of arbitration by sending written notice to support@trybuildr.co within 30 days of first accepting these Terms.
10.5.
Each Party bears its own arbitration costs unless otherwise required by law.
11. Termination
11.1.
You may terminate by canceling your subscription or ceasing use of the Services.
11.2.
Buildr may suspend or terminate access if:
You breach these Terms;
You engage in unlawful conduct;
Payment fails;
Required by law;
The Services are discontinued.
11.3.
Sections intended to survive termination shall survive.
12. General Provisions
12.1.
These Terms constitute the entire agreement between you and Buildr.
12.2.
Buildr may revise these Terms at any time. Material changes will be communicated.
12.3.
If any provision is invalid, the remaining provisions remain enforceable.
12.4.
These Terms are governed by the laws of the State of Delaware.
12.5.
You may not assign your rights. Buildr may assign without restriction.
12.6.
Nothing creates a partnership, joint venture, or agency relationship.
